Customs Compliance Manager Organizational Structure Location • Reports to: Director of Logistics • Supervision of: Customs Compliance Team in Mexico / Analysis of origin qualification of finished goods according to Rules of Origin of Trade Agreements / Foreign Trade Coordinators, Internal Foreign Trade Auditors. • Interaction with: Operations, Logistics, Purchasing, Finance, Legal, Internal Audit, Customs Brokers. Purpose / Mission of the Position Ensure that all the company’s foreign trade operations (import, export, programs related to IMMEX, qualification of origin of finished products, and payment of Duties in Mexico and the USA) are carried out in compliance with customs, tax, and foreign trade regulations applicable in Mexico and the USA, minimizing legal, fiscal, and administrative risks. Guarantee that the company is in Compliance with the requirements and obligations of the IVA-IEPS, Authorized Economic Operator (OEA), and C-TPAT (Customs-Trade Partnership Against Terrorism) certifications. Determine the correct tariff classification of import and export products based on applicable legal provisions. Carry out responsibilities in coordination with the Traffic and Operational areas of the Customs Department. Main Functions and Responsibilities A. Fiscal and Customs Certifications Lead the IVA-IEPS Certification process applicable to imports, ensuring that the company meets legal requirements, maintains adequate documentation, manages audits, and submits required reports to the authority. Manage and maintain the Authorized Economic Operator (OEA) Certification, coordinate audits, improvement plans, internal controls, document maintenance, personnel training, and periodic process review. Manage and maintain the CTPAT (Customs-Trade Partnership Against Terrorism, U.S.) Certification: coordinate supply chain security actions, internal and external audits, risk mitigation, and compliance with program standards. B. Origin and Trade Agreements Design and execute the origin analysis program for finished products, applying the Rules of Origin of the Free Trade Agreement with the USA and Canada (T-MEC / USMCA). Perform origin compliance evaluations, calculation of regional / non-regional value content, analysis of critical inputs, calculation methodology, De Minimis, and origin audits. Prepare supporting origin documentation (forms, supplier certifications) and coordinate third-party reviews. Identify tariff optimization opportunities through the use of preferential tariffs and special foreign trade programs (Prosec, IMMEX, etc.). C. Customs / Fiscal / Commercial Regulatory Compliance Interpret and keep updated Compliance with Mexican regulations: Customs Law and its Regulations, Foreign Trade Law and its Regulations, VAT Law, General Import and Export Tax Law, General Rules of Foreign Trade, IMMEX and Prosec Decrees, etc. Interpret international regulations when applicable (example: US Harmonized Tariff Schedule, U.S. customs legislation). Review and approve tariff classifications for imports / exports, in coordination with operational teams and customs brokers. Supervise internal and external audits in customs / foreign trade matters; coordinate responses to authority requests. Develop compliance indicators (KPI), risk reports, compliance monitoring, and early alerts. Propose, design, and implement internal controls, policies, procedures, and best practices of Customs Compliance. Train and disseminate among personnel of Foreign Trade, Logistics, and related departments (purchasing, quality, production) the regulations, risks, and Responsibilities. Coordinate with Legal / Fiscal / Internal Audit areas to evaluate implications of sanctions, contingencies, fines, and review notices. Evaluate and propose continuous improvements in processes, operational efficiency, and risk mitigation. Technical Knowledge and Required Competencies To successfully perform this position, the person must have: A. Legal / Regulatory Technical Knowledge • Customs Law and its Regulations. • Foreign Trade Law and its Regulations. • VAT Law (Value Added Tax). • General Rules of Foreign Trade. • IMMEX Decree, PROSEC Decree, and related regulations. • General Import and Export Tax Law. • Free Trade Agreement TMEC / USMCA and its Rules of Origin. • U.S. Tariffs / USHTS / U.S. Harmonized Tariff Schedule. • Supply chain security regulations (C-TPAT). • Authorized Economic Operator (OEA) certification regulations. • Customs value, customs valuation. • Fiscal knowledge related to imports/exports and its impact on VAT / taxes. B. Interpersonal / Management Skills and Competencies • Analytical thinking and complex problem-solving. • Leadership, motivation, and management of multidisciplinary teams. • Clear verbal and written communication (in Spanish and technical English). • Attention to detail and strict compliance focus. • Ability to work under pressure, with multiple priorities and tight deadlines. • High confidentiality, professional ethics, and integrity. Required Experience • Bachelor’s degree in Foreign Trade, Law, International Relations, Administration, or related field. • At least 3 to 5 years of experience in similar roles in customs compliance / foreign trade / customs certifications (OEA, CTPAT, IVA-IEPS). • Proven experience in rules of origin analysis and trade agreements. • Experience leading internal/external audits in foreign trade. • Experience in implementation or maintenance of IVA-IEPS, OEA, and CTPAT certifications. • Desirable experience in industries with intensive import/export operations. • Experience working with customs brokers (desirable). • English (reading, writing) required, intermediate to advanced level (depending on the international scope of the company).
